Are Court Records Public in Warren County?

Yes. Under Missouri Sunshine Law, Codified in Missouri Statutes Chapter 610, most records of public governmental bodies, including courts, are open to the public. As a result, court records are considered part of Warren County Public Records, and anyone can query local courts in Warren County to access and request court records they maintain. Additionally, Missouri Sunshine Law provides that a statement of purpose is not required to access or request these records.

However, RSMo Section 610.021 highlights several exceptions to the Missouri Sunshine Law that can warrant nondisclosure of specific records. These include but are not limited to:

  • Records of an ongoing litigation involving a governmental body protected by attorney-client privilege.
  • Welfare cases of identifiable individuals
  • Records protected from disclosure by law or court order
  • Juvenile court records (RSMo Section 211.321)

Warren County Criminal and Civil Records

Warren County Circuit Court has original jurisdiction over civil and criminal cases that arise in the County. Hence, all requests for Warren County criminal and civil court records should be directed to the County Circuit Clerk's office. Hence, Warren County vital records, including marriage statements since July 1, 1948, can be obtained through the DHSS Bureau of Vital Records. Warren County Divorce Records

In Warren County, divorce proceedings are handled by the County Circuit Court. As a result, Interested persons can contact the Warren County Circuit Court Clerk to obtain original divorce decrees.

Similar to marriage records, record seekers can also order copies of a Warren County divorce statement from July 1, 1948, to the present through the DHSS Bureau of Vital Records using the Bureau's Application for Vital Record form. Record seekers must appropriately complete the application form's "divorce statement" section. Afterward, the completed Application may be submitted together with other required items to the DHSS Bureau of Vital Records by mail or in person.

Warren County Birth Records

Record seekers can obtain Warren County birth records at the state level through the DHSS Bureau of Vital Records and at the local level through the Warren County Health Department. Birth records from 1910 to the present are available through the DHSS Bureau of Vital Records, while birth records from 1920 to the present are available through the Warren County Health Department.

Per 19 CSR 10-10, certified copies of Warren County birth certificates are only accessible to select individuals. These include individuals who have direct and tangible interest in the certificate, such as the registrant, their immediate family members, or official representatives of these select individuals. Hence, identification is required when ordering a Warren County birth certificate from either the DHSS Bureau of Vital Records or the Warren County Health Department. This identification includes a document containing a photo of the requester, such as a driver's license, passport, or school, work, or military identification. Note that both agencies charge a $15 fee for each copy of a birth certificate they provide

Eligible persons can order Warren County birth records from the Warren County Health Department by completing the Application for a copy of birth or death certification. The completed Application, along with the requester's ID and required fee, should be submitted in person or by mail to the Warren County Health Department. The agency's contact information and address are provided in the application form. On the other hand, requesters who choose to make requests via the DHSS Bureau of Vital Records can complete the Application for Missouri Vital Record - birth/death form. Requesters should submit the completed Application, the required fee, and the requester's ID to the agency in person or by mail. Warren County Death Records

Like birth records, Warren County death records are considered confidential and only issued to eligible persons. They are also accessible through different agencies, such as the Warren County Health Department (from 1980 to the present) and the DHSS Bureau of Vital Records (1910 to the present). Both agencies charge requesters a $14 fee for death records requests.

Eligible persons can request death records from the Warren County Health Department by completing the Application for a copy of birth or death certification and submitting it to the agency along with the required items and fee. On the other hand, eligible requesters can complete the Application for Missouri Vital Record - birth/death form and submit it along with the required fees and the requester's ID to the DHSS Bureau of Vital Records to request relevant death records.

Warren County Probate Court Records

The Probate Division of Warren County Circuit Court handles probate cases in the County. Hence, Warren County Probate Court records requests can be directed to the Circuit Clerk's office. Record seekers can access probate records by visiting the Warren County Circuit Courthouse and using the public access terminal provided in the courthouse to access public probate court records electronically.
