Platte County Arrest Records Vs. Criminal Records
In Platte County, Missouri, there is a clear distinction between arrest records and criminal records, both of which play crucial roles in the criminal justice system. Arrest records are documents that detail the circumstances surrounding an individual’s apprehension by law enforcement. These records include the date, time, location, and reason for the arrest, as well as the charges filed at the time.
However, an arrest record merely indicates that a person was detained; it does not necessarily imply guilt or result in a criminal conviction. Arrest records are often public, though access may be restricted in certain cases, such as those involving minors.
On the other hand, criminal records provide a comprehensive account of an individual’s criminal history, encompassing more than just arrests. These records include details of charges, court proceedings, convictions, and sentences. Criminal records offer a full picture of an individual’s interactions with the criminal justice system, from the moment of arrest through the final legal outcomes. They are often used for background checks and are generally more restrictive in terms of public access, especially if the records involve juveniles or have been expunged.
The primary difference between the two lies in their scope and implications. While arrest records focus solely on the event of an arrest, criminal records provide a broader view, including convictions that establish legal guilt. Being listed in an arrest record does not mean an individual was found guilty, whereas a criminal record indicates that a legal process resulted in a conviction.
How Long Do Arrests Stay on Your Record?
In Missouri, arrests generally stay on a person’s record indefinitely unless they are expunged. Missouri law does not automatically remove arrest records, so they can remain visible unless a legal expungement process is completed. Expungement may be available under certain conditions, such as if charges were dismissed or if the individual was acquitted.
Expunge Platte County Arrest Records
Expunging or sealing arrest records in Platte County, Missouri, involves a legal process that can clear or limit access to certain criminal records. According to the Missouri expungement law, individuals with certain criminal records may elect to have their offenses sealed and expunged.
Individuals can only apply to have their records expunged when:
- Fines have been paid off
- Completion of probation and/or parole
- Having a three-year clean date for eligibility for a felony offense expungement
- Having a one-year wait after misdemeanor offense
To initiate the process to seal and/or expunge a criminal record in the state, requesters should:
- File a petition at the court in the county where the offender was found guilty and charged by downloading the Petition for Expungement of Records. The cost for this is $250, however the cost can be waived by the judge if the petitioner can prove they are unable to bear the cost.
- The petition will name defendants of any entities or individuals that are holding these records of offenses and violations which are then served.
- Defendants will then have 30 days to file any objections they may have to the expungement petition.
- The court will then hold a hearing within 60 days of any objections made by the defendant or 30 days after the defendants have been served with no objections.
- Once the court approves the petition, the petitioner can now maintain that they have not been convicted of a crime. However, certain applications still necessitate disclosing these records such as when applying for a license, certificate and permit issued by the state for the individual’s profession.
- If the expungement is denied, the petitioner could re-file within a year or appeal the decision of denial.
Note: More than one expungement can be granted, provided the number does not exceed one felony offense, two misdemeanors, or ordinance violations that have led to imprisonment.
It should be stated, however, that there are certain offenses that are not eligible for expungement, such as:
- Class A felonies
- Offenses that require registration of a sex offender
- Felonies where death is the element of the offense
- Crimes that involve domestic assault and/or kidnapping
Petitioners are generally advised to retain the services of legal counsel when completing this process, although it is possible for individuals to perform a self-petition.
