Henry County Arrest Records

When a law enforcement officer in Henry County witnesses a crime, the alleged offender may be arrested and taken into custody to begin the criminal justice process. Arrests may also be made based on a warrant or probable cause that an individual engaged in illegal activity (§ 544.180, RSMo). Individuals arrested in Henry are typically transported to the nearest police precinct or jail, where they will be booked for the offense and may be temporarily held pending their court appearance or transfer (when another jurisdiction has authority over the offense).

Several law enforcement agencies in Henry County, including the Henry County Sheriff's Office, are responsible for generating arrest records. These documents are compiled during booking procedures and provide pertinent details about the offender and offense. Typically, the agency that executes an arrest prepares and maintains the related arrest record. However, as these documents are transmitted to different criminal justice departments, they may become part of other public records, like the Henry County court records and Missouri criminal history files.

Are Arrest Records Public in Henry County?

Yes. Missouri's Sunshine Law (Chapter 610, RSMo) facilitates the release of arrest records to members of the public, irrespective of the Missouri jurisdiction in which a record is created or stored. However, the law withholds specific arrest information and documents where disclosure would jeopardize a criminal investigation, unreasonably violate a person's privacy, pose a safety threat, or bias a trial. Following § 610.100, RSMo, Henry County law enforcement agencies are prohibited from publicly disseminating these records:

  • Juvenile offender documents
  • Arrests where charges were not filed within 30 days
  • Sealed or expunged records
  • Medical and mental health files
  • Social Security information
  • Materials (mobile video recordings, investigative reports, etc.) from active investigations

Find Henry County Arrest Records

Individuals can retrieve Henry County arrest records from the local police division that conducted the arrest. Agencies that carry out enforcement actions (like arrests) in Henry County include the Henry County Sheriff's Office, Deepwater Police Department, and Clinton Police Department. Any of these agencies can receive an arrest records request (bearing identifying details like the arrest date, arrestee's name, or arrestee's date of birth) and furnish matching records to the requester. Copies of these records may be subject to fees.

However, where the local arresting agency is unknown, one may inquire at the Henry County Sheriff's Office, the county's primary law enforcement agency. Below is the office's address information:

200 North Main Street
Clinton, MO 64735
Phone: (660) 885-7300

The Sheriff's Office can provide information about individuals taken into custody in Henry unless the subject of the search has been transferred to state or federal custody. To locate a person incarcerated in a state penitentiary after legal proceedings, one can access the Missouri Department of Corrections (MODOC) Offender Search portal. Meanwhile, federal inmates can be located via the online Inmate Search database furnished by the Federal Bureau of Prisons.

Notably, Henry County arrest records are also available from the Missouri State Highway Patrol's Criminal Justice Information Services (CJIS) as part of the statewide criminal history files. A minimum $15 fee applies to obtain records from this department (view ordering guidelines on the Patrol's Criminal Record Check page). However, not every arrest becomes part of a formal criminal record; certain ordinance or misdemeanor-level arrests are not reported to the CJIS and may only be found at local police agencies.

Free Arrest Record Search in Henry County

When requesting arrest records through government agencies in Henry County, a fee may not be assessed if the requester submits an open records inspection request (where the goal is to review or read information/documents/reports without acquiring a copy). However, if an agency should produce a copy to satisfy a request, the inquirer will be charged the associated fees, if any.

Another way to conduct a free arrest record search in Henry County is to access a third-party aggregator database. These systems disseminate various public records to interested persons, but while basic name searches may be free, the user may be charged for full access or to obtain detailed information.

How Long Do Arrests Stay on Your Record?

Permanently. Missouri's legislature does not specify a timeline for deleting or destroying arrests that took place in Henry County. Typically, these incidents remain on a person's criminal history and may be accessible to family members, colleagues, journalists, landlords, employers, and others upon a criminal background check. However, the state allows qualified arrestees to remove their arrest records from public view, which can help mitigate social, legal, or financial repercussions that may stem from an arrest record.

Expunge Henry County Arrest Records

To expunge arrest records in Henry County, a defendant (the subject of the record) can file Form CR 145: Petition for Expungement of Arrest Records with the Henry County Circuit Court and pay the necessary filing costs.

Only persons deemed eligible under Missouri law (§§ 610.122 through 610.126, RSMo) can present this petition to the court. They include:

  • Individuals whose arrest was based on false information, and these conditions exist:
    • No probable cause that the defendant (accused) committed the offense;
    • No charges will be pursued for the arrest; and
    • The defendant did not receive a suspended sentence for the alleged offense or any offense related to the arrest
  • Persons arrested for/charged with a misdemeanor offense of Chapter 303, RSMo, or a moving violation defined under § 302.010, RSMo (except for an intoxication-related traffic offense defined under § 577.023, RSMo), and
    • The case was nolle prossed or dismissed, or the defendant was acquitted; and
    • The defendant does not possess a commercial driver's license and was not operating/driving a commercial motor vehicle when apprehended.

Further, in either scenario, no civil action related to the arrest or record to be expunged must be pending.

After submitting the petition, the court will schedule a hearing no sooner than 30 days from the filing date and notify all agencies or entities named therein. If the court finds merit in the defendant's request, it will enter an order of expungement, ultimately sealing the records from general public access. Expunged data may still be visible to law enforcement and courts, however.

Note that an expungement does not remove information from third-party systems. As such, it is crucial to keep a copy of the court order to request deletion from these systems/databases after a successful expungement.

For other types of expungement that can be filed in Henry County (including conviction expungements), one may read the state judiciary's Expungement Forms page.

Henry County Arrest Warrants

Circuit judges, associate circuit judges, municipal judges, and court clerks in Henry County have the power to issue arrest warrants. These written orders permit the police to legally arrest a person suspected of a criminal violation, and usually list the suspect, the alleged offense, the issuing jurisdiction and date, the issuing officer's signature, and release conditions (if applicable).

Under Chapter 544, RSMo, and the Fourth Amendment, the court must determine "probable cause" before an arrest warrant can be issued in Henry County. The prosecuting attorney or investigating law enforcement officer is responsible for demonstrating probable cause for an arrest via a sworn complaint. (Probable Cause: Information that will lead a person of reasonable caution to believe that a particular individual is in the process of committing, has committed, or will commit a crime.)

Still, courts can issue arrest warrants "from the bench" (also called "bench warrants") when someone refuses or fails to obey a court order or summons.

Individuals who suspect they have an arrest warrant in Henry County may contact local authorities or search available online databases, such as the MissouriCase.net portal.

Do Henry County Arrest Warrants Expire?

No, Henry County arrest warrants do not expire. These orders are not subject to any statutory limitations that prevent their execution. As a result, the subject of an arrest warrant can be apprehended wherever they are discovered, even if years or decades have lapsed from the date of issuance. Notwithstanding, a court can quash or recall an arrest warrant if the subject is deceased, charges are dropped, or for any other sufficient basis.
