Boone County Arrest Records
A Boone County peace officer is authorized to make an arrest with or without a warrant. Per RSMo § 544.216, an officer can arrest on view without a warrant when they see a person violating the law or have reasonable grounds to believe the person has violated any state law.
Upon arrest, the peace officer will take the person to intake at the Boone County Jail and book them. The officer will complete the booking form and forward it to the jail staff for completion of the booking process. The office will also complete the arrestee's property and medical forms and take their mugshot and fingerprints. The person's photograph will be taken using the digital photographic system, which will associate the arrested person's photograph with their jail documents. Also, the arrested person's fingerprints will be captured using the LiveScan system, which is tied directly to the Missouri Highway Patrol fingerprint repository. After the booking, the officer will complete all the paperwork for the arrest.
If a warrant was issued for the person's arrest, a copy of the warrant will be attached to the booking paperwork. The officer will type the offense report associated with the arrest into the Sheriff's Office report management system before the reporting officer's shift ends. Individuals arrested and detained in the Boone County jail without a warrant must be released within 24 hours of their arrest unless they are charged with a criminal offense and held under a warrant to respond to that charge.
Per RSMo § 544.260, anyone arrested under a warrant will be brought before the issuing judge. If the offense is bailable, the judge can order the person's release pending trial, appeal, or other stage of the proceedings against the person's personal recognizance unless the judge determines that the person's appearance in court is not guaranteed (RSMo § 544.455).
All the arrestee's booking, property, medical, and officer's arrest or offense reports are compiled to generate an arrest record. Although arrest records are public information, like Boone County court records, some portions are not available for public perusal. Record seekers can inspect or obtain copies of public arrest records online or in person at the Boone County Sheriff's Office.
Are Arrest Records Public in Boone County?
Yes. The Missouri Sunshine Law considers arrests open records. Therefore, anyone can access arrest records in the custody of any law enforcement agency in Boone County. The most common methods of submitting an arrest record request in Boone County are online and in person during business hours. The Missouri Sunshine Law exempts some arrest records or portions of them from public disclosure. These confidential arrest records are only open to record holders, legal representatives, criminal justice agencies, and persons with a court order. Typically, the following arrest records are not available to the public:
- Juvenile arrest records
- Arrestee's medical records
- A mobile video recording of an arrest that is recorded in a nonpublic location
- An arrest report of a person not charged with an offense against within thirty (30) days of the arrest is confidential. Only the disposition portion of the record will be available to the public.
- A law enforcement agency's mobile video recordings and investigative reports.
- Any records maintained by the Department of Health and Senior Services' Missouri state public health laboratory resulting from a test performed at the request of any law enforcement agency are confidential until the investigation becomes inactive.
- Any arrest record that contains information:
- That can likely pose a clear danger to the safety of anyone, including a witness, victim, or undercover officer.
- That can jeopardize a criminal investigation, including records that would reveal the identity of a confidential source or a suspect not in custody.
- Which would disclose procedures, techniques, or guidelines for law enforcement investigations or prosecutions
What Do Public Arrest Records Contain?
Most Boone County arrest records are publicly available online or in person at the Sheriff's Office. Residents can access the following information in a public arrest record:
- Mughshot
- Arrestee's full name and aliases
- Arrestee's date of birth
- Arrest date and time
- Detainee information (height, weight, sex, eye and hair color, race, age, city, and state)
- Case number
- Charge description and status
- Bail amount and bond type
- Court date, time, and jurisdiction
- Release information
Boone County Crime Rate
The Missouri State Highway Patrol (MSHP) has a Crime Portal that publishes crime data from different law enforcement agencies. Users must select a Jurisdiction, Year, and Theme to conduct a search. The portal reveals that the Boone County Sheriff's Office recorded over 1,038 in 2023. Crime against society totaled 108, property crimes were 756, and violent crimes were 174. The three (3) major crimes committed that year were larceny-theft (451), fraud (126), and motor vehicle theft (100). The crimes recorded in 2023 show a decrease compared to those in 2022. The Boone County Sheriff's Office recorded over 1,088 crimes in 2022, with 74 crimes against society, 768 property crimes, and 246 violent crimes.

The Missouri State Highway Patrol's Statistical Analysis Center recorded approximately 896 arrests in Boone County in 2018. Most of the arrests were for larceny-theft crimes. That same year, Boone County had about 904 index offense arrests and about 5,419 non-index arrests.

- The U.S. Immigration and Customs Enforcement (ICE) provides arrest records to members of the public online through its Online Detainee Locator System. The search parameters are an A-Number or biographical information. Alternatively, inquirers can request an arrest record at any local field office or detention facility. A name or arrest date may be required to process the request.
Free Arrest Record Search in Boone County
The Boone County Sheriff's Office provides free access to arrest records online through its Current Detainee's portal. The search criteria are last name or first name. Individuals can view arrest records at the Sheriff's Office at no cost. The record staff will require a name or arrest date to process the request. Then, the staff will allow the requester to view the record electronically or on paper. Printing or photocopying of records will attract a fee. The Missouri State Highway Patrol also has an Online Arrest Reports tool where individuals can find Boone County arrest records without charges. Users can search by first name, last name, arrest county, troop, person city/state, or arrest date.
Alternatively, several third-party sites provide Boone County arrest records to members of the public without charges. However, this is only possible at the initial stage of the search. Comprehensive searches attract a small fee because a full arrest report is available for download.
Get Boone County Criminal Records
The Missouri State Highway Patrol's Criminal Justice Information Services (CJIS) Division maintains the criminal history records of all arrested persons. Interested persons can obtain Boone County criminal records online through the Missouri Automated Criminal History Site (MACHS). A fee of $15.00 per request is required for the search. The MACHS has two portals for name and fingerprint-based searches:
- MACHS Name Search Portal: Users can request and receive personal identifier criminal records checks online by performing a name-based search. An account must be created, and an email address and password are needed to log into the portal. The fee for this search is $15.00, plus a small convenience fee payable by credit card. The processing time is about five (5) to seven (7) business days. A name-based search will provide records containing convictions, charges awaiting final disposition from the court, and arrest information less than 30 days from the arrest date. It will also reveal records that contain a suspended imposition of sentence (SIS) during the probation period.
- MACHS Fingerprint Search Portal: Members can use this portal to schedule an appointment to be fingerprinted through an approved fingerprint services vendor. The vendor will capture the applicant's fingerprints electronically and send them to the MSHP for processing. The processing time for a fingerprint-based criminal record search is between seven and ten business days. The criminal record search result will be mailed to the applicant or qualified entity. The MSHP charges $20 for fingerprint-based criminal records searches. The third-party vendor charges an additional service fee of $11.50 per applicant. Fees must be paid by check or money order. A fingerprint-based search will provide access to closed records like criminal history data, charges that have been nolle prossed, dismissed, or acquitted in a court of law, SIS after completion of probation, and expunged arrest records.
Non-Missouri applicants requesting fingerprint-based criminal records can contact their state's local law enforcement agency for fingerprint assistance. The applicant's fingerprints and personal identifying information must be completed on an FBI standardized Applicant Fingerprint Card (FD-258). The MSHP accepts both electronic and ink fingerprint images. The processing time is between 4 and 6 weeks. The completed applicant's fingerprint card should be mailed with appropriate fees to:

Boone County Arrest Records Vs. Criminal Records
Per RSMo § 610.100, an arrest record is a documentation by a law enforcement agency of an individual's arrest, detention, or confinement and the charges stemming from the arrest. Conversely, criminal records are information created by criminal justice agencies on a person that consists of their identifiable descriptions and notations of arrests, detentions, indictments, information, criminal charges, and disposition.
How Long Do Arrests Stay on Your Record?
In Boone County, arrest stays on a person's record indefinitely unless the record is expunged. This means that even if the charges were dropped, the arrest record will still appear on a background check. However, the Missouri Secretary of State (SOS) provides minimum retention periods for arrest records in its Sheriff Records Retention Schedule. For example, arrest records, logs, files, registers, register IDs, fingerprints, and booking sheets are kept for five (5) years. Expungement orders of arrest records are retained as long as the underlying incident file. Use of force reports are kept for five (5) years from the end of the investigation.
Expunge Boone County Arrest Records
Per RSMo § 610.122, a Boone County arrest record will be expunged if:
- The court determines that the arrest was based on misinformation, and the following conditions exist:
- There is no probable cause to believe the arrested person committed the offense.
- No charges will be filed due to the arrest
- The arrested person did not receive a suspended imposition of sentence due to the arrest.
- The court determines the person was arrested for or was charged with a misdemeanor offense of chapter 303 or any moving violation except for any intoxication-related traffic offense and:
- The offense related to the arrest was subsequently dismissed, or the accused was acquitted and
- The individual arrested does not hold a commercial driver's license and was not driving a commercial vehicle at the time of the arrest.
Applicants must file a completed CR 145 Petition for Expungement of Arrest Records form with the Boone County Circuit Clerk's Office. The form must be submitted with the appropriate filing fee of $100.50. The clerk will send a copy of the petition to the prosecuting attorney and a copy of the fingerprint card to the Missouri Criminal Record Repository. The clerk will schedule a hearing on the matter within thirty days and notify the prosecuting attorney and the persons or entities named in the petition of the hearing. If the clerk finds the applicant eligible for expungement, an order will be entered directing expungement. Upon granting the order of expungement, the applicant's arrest records will become confidential and only open to eligible persons. A copy of the order will be sent to all agencies identified in the petition.
Boone County Arrest Warrants
Per Mo. R. Crim. P. 22.04 and 21.3, an arrest warrant is issued when a complaint or information is filed, there is probable cause to believe a felony or misdemeanor has been committed, and the defendant is considered dangerous or unlikely to appear in response to a summons. An arrest warrant is usually in writing, issued in the name of the state, and directed to any peace officer in the state. Per Mo. R. Crim. P. 22.05 and 21.6, an arrest warrant contains the following information:
- The defendant's name but, if not known, any name or description by which they can be identified.
- A description of the offense
- The issuing date and county
- A command that named or described the defendant be arrested and brought before the court designated in the warrant.
- Specify the condition or combination of conditions of release
- Have the court's signature
Boone County Arrest Warrant Search
The Boone County Sheriff's Office has an Active Warrant List where record seekers can freely find current outstanding misdemeanor and traffic warrants (over 30 days old) and felony warrants (over 90 days old). Do Boone County Arrest Warrants Expire?
No. All arrest warrants issued in Boone County do not have expiry dates. They cease to be active after they are executed or recalled by the court.
